Terms of Use

Except as otherwise provided herein, Purchaser's placement of an order for Products confirms its agreement with each of the terms of Bosolo, Inc. Terms and Conditions of Use, the Privacy Policy, these Terms and Conditions of Sale and the terms of Bosolo, Inc. order acknowledgement and invoice for Products. These Terms and Conditions of Sale apply unless Purchaser has signed a separate purchase agreement with Bosolo, Inc. governing Purchaser's purchase of Products in which case the terms of any such signed agreement shall govern.  Purchaser agrees that no order shall be deemed to have been accepted unless and until it is verified and accepted by Bosolo, Inc. which may be by means of shipment of Products. The use of this Site requires the use of a password and user identification number when ordering Products.  See My Account for further information. Purchaser represents and warrants to Bosolo, Inc. it will restrict the ordering of Products on its behalf to those people within its organization who have express authorization to purchase Products on Purchaser's open account.

Pricing:

The prices under this agreement are F.O.B. point of shipment and exclusive of all sales, use, excise or other taxes.  The prices set forth can be changed without notification from Bosolo, Inc. and Bosolo, Inc. reserves the right to adjust prices at its discretion.

Payment:

Except as otherwise stated in any attachment, terms are net due upon purchase.  Payment method will be echeck or credit card (Visa, MasterCard, American Express or Discover).  Buyer agrees to pay all credit card penalties, late charges, and collection fees.  Collection fees carry a minimum charge of 25% of total invoice or $125  If you are interested in account terms other than due upon purchase, please contact our accounting department [email protected] (855)286-3368.

Taxes:

Purchaser shall pay all federal, state, municipal or other sales, use, excise or other taxes, assessments and charges assessed or levied against the products and/or services.  Purchaser agrees to pay to Bosolo, Inc. on request any federal, state, municipal or other sales, use, excise or other taxes, assessments or charges payable by Bosolo, Inc. with respect to the products and/or services of the sale thereof.

Shipping:

Delivery will be F.O.B. point of shipment.  Unless otherwise directed by Purchaser, Bosolo, Inc. will pre-pay the freight and bill Purchaser for shipping and handling charges.  Purchaser assumes all risk of loss during delivery of the Products by Bosolo, Inc. to the carrier.  In the absence of instructions to the contrary, Bosolo, Inc. on behalf of the Purchaser, shall exercise its own discretion as to the method of shipment to be used and the selection of the carrier but shall not be deemed thereby to assume any liability in connection with the shipment nor shall the carrier thereby be deemed an agent of Bosolo, Inc.  No goods shall be returned for credit or replacement without prior RMA authorization by Bosolo, Inc..  All good returned without such prior authorization will not be accepted by Bosolo, Inc. and will be returned to the purchaser freight collect.

When you receive your shipment, locate your packing slip and compare it to your Bosolo, Inc. Invoice.  Please unpack your shipment carefully to be sure every piece you have purchased has been shipped.

Warranty:

Bosolo, Inc. does not represent or warrant that the functions contained in this website will be uninterrupted or error-free.

Regarding product warranties, Bosolo, Inc. warrants all products purchased directly from Bosolo.com according to the manufacturers warranties. Refer to the product detail pages for more specifics on the warranty duration for each product.

In the event of a defective product:

Customer Service will arrange for the return of the defect product.
Returned Product – An inspection and a series of tests will be performed to determine defectiveness.
Replacement Product – If the Product is deemed defective a replacement with be sent out immediately.

Disclaimer and Limitation of Liability:

Bosolo, Inc.  shall in no event be liable for damages, including but not limited to incidental or consequential damages, for injury to any property or to any person, by reason of the person's negligence or otherwise in connection with the safety, delivery, installation or use of the products and/or provision of services pursuant to this agreement, and purchaser shall indemnify and hold harmless Bosolo, Inc. against further liability.  Without limiting the generality of the foregoing, Bosolo, Inc. shall in no event be liable for lost profits or costs arising out of installation , replacement of hardware, or in connection with, this agreement.  Neither Bosolo, Inc. nor purchaser shall be liable for delay in the performance of any of its obligations under this agreement arising out of causes beyond its control, including but not limited to acts of God, governmental action, fires, floods, epidemics, quarantines, strikes, embargoes, or severe weather.

General Provisions:

This agreement shall be binding upon and inure to the benefit of the parties and their respective successors and permitted assigns.  Neither this agreement nor any variation or modification of this agreement or waiver of any of the terms or provisions hereof shall be deemed valid and binding upon Bosolo, Inc. unless in writing, signed by an officer of Bosolo, Inc. and delivered by Bosolo, Inc. to Purchaser.   Failure by either party to enforce the terms hereof shall not be deemed a waiver of future enforcement of that or any other term.  This agreement shall be construed and interpreted in accordance with the laws of the State of Missouri.

Bosolo, Inc. will provide free technical support services.  Technical support is provided through our Customer Service [email protected] (855) 286-3368. 

Credit Card Charge Backs.

All credit card charge backs will be considered by Bosolo, Inc. as a refusal to pay for delivered products.  All delinquent invoices will be immediately sold to Credit Collection Agencies for collections.  They will add a fee of up to 30% for collections to your existing balance.
